If the user uses this Site or Services to transmit information or materials to PrACSI, the user must ensure that such information is neither confidential nor proprietary, as PrACSI will deem all such information or materials so transmitted to be non confidential and non-proprietary and may use them without restriction, and without payment to or consent of the user. Such use will include without limitation, the right to reproduce, show, convey and disseminate such information and materials within PrACSI and its affiliated companies.
Supply Web Application Services
MeTAS provides on this Site a crude and condensate Supply Web Application Service ("SWAS"), access to which is restricted to certain customers of PrACSI. Customers may upon authentication of identity log in to view certain particulars and data relating to their contract for the supply of crude and condensate for information only.
These Terms shall apply to SWAS. The general Terms and Conditions of the Sale Contract between the customer and PrACSI will also apply and will not be deemed to be modified or amended by these Terms. However, the status of particular consignments, vessel nominations and lifting details vary. The customer may rely upon such data as it varies from time to time only if the variation is requested to be validated as at a particular date by the customer contacting PrACSI by email, fax or telex and MeTAS confirms such validation. Otherwise, PrACSI accepts no liability whatsoever for the accuracy or completeness of the customer's data or information accessed through SWAS or the customers inability for any reason to access such data or information.
Applicable law and Dispute Resolution
This agreement and these Terms and the use of this Site and Services shall be governed by and interpreted in accordance with the laws of the Emirate of Abu Dhabi and the United Arab Emirates and the civil courts of the Emirate of Abu Dhabi shall have exclusive jurisdiction over any dispute or difference arising out of this agreement, these Terms and the use of this Site and Services.
As of May 2003, PrACSI has signed a contract with Quality & Environmental Developments (QED) for a quality assurance program which will lead us to an international standards certification.
